This is an application for grant of regular bail on behalf of the petitioner who is an accused in connection with Brahampura PS Case No. 140 of 2015 for the alleged offence punishable under Sections 419, 420, 406 and 506/34 of the Indian Penal Code which is pending in the court of learned Chief Judicial Magistrate, Muzaffarpur.
As per the prosecution case, the petitioner is said to have assured the informant Government job on payment of illegal money in the year 2011. When the informant lost hope, though he had paid certain amount to the petitioner to the tune of
Patna High Court Cr.Misc. No.46026 of 2015 (2) dt.08-10-2015 2/2 Rs.18,25,000/- for illegally securing a government job, he filed the present FIR on 14.5.2015.
Keeping in view the submission that the conduct of the informant himself is suspicious, this application is allowed. Let the petitioner above-named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Brahampura PS Case No. 140 of 2015.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
