JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is said to have forcibly established physical relation with the informant and subsequently, he promised for marriage but, later on, retreated from his promise. Learned counsel for the petitioner submits that the informant is a lady of questionable character and, as a matter of fact, she is in habit of filing false cases against innocent persons with intent to blackmail them. It is pointed out that prior to filing of the present case, the informant filed Complaint Case No. 518(C)/2012 for the offences punishable under Section 376 read
Patna High Court Cr.Misc. No.46130 of 2015 (2) dt.01-10-2015 2/2 with Section 511 and other minor Sections of the IPC and on the basis of the said complaint case Asthama P.S. Case No. 72/2012 was registered. The police investigated the aforesaid case and found the accusation untrue and accordingly, submitted final form which was accepted by the learned Chief Judicial Magistrate.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Asthawan P.S. Case No. 42 of 2014 to the satisfaction of the Chief Judicial Magistrate, Nalanda. (Hemant Kumar Srivastava, J) S.Pandey/- U
