Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 302, 120B of the Indian Penal Code and Section 27 of the Arms Act. The petitioner has suppressed his criminal antecedent by making wrong statement on oath sworn by the wife of the petitioner that the petitioner has fair and unblemished record. When the informant filed counter affidavit disclosing two criminal cases pending against the petitioner and information about some other cases, the petitioner filed second supplementary affidavit disclosing the five or six criminal cases pending against him.
Considering the aforesaid suppression without going
Patna High Court Cr.Misc. No.3781 of 2018 (5) dt.16-03-2018 2/2 into the merit of this case, I am not inclined to enlarge the petitioner on bail at this stage in connection with Danapur P.S. Case No. 547 of 2017 pending in the Court of learned Additional Chief Judicial Magistrate, Danapur, Patna.
The learned trial court is directed to expedite the trial and conclude the same within a period of nine months from the date of receipt/production of a copy of this order, failing which the petitioner would be at liberty to renew the prayer for bail. (Birendra Kumar, J) Kundan/- U T
