JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-11-2015 This is an application for grant of regular bail in favour of the petitioner who is an accused in connection with Narari Kala Khurd PS Case No. 5 of 2015 for the alleged offence punishable under Section 392 of the Indian Penal Code. Learned counsel for the petitioner submits that the FIR was instituted against unknown persons. The petitioner's name surfaced in course of investigation along with 12 other persons on the basis of confessional statement of co-accused Debesh Singh. He submits that out of the said 12 persons, Ramji Choudhary, Hiralal Rathod and Shatrughan Choudhary whose names also surfaced on the basis of the confessional statement of the co-accused, have been granted bail by the court below itself. It has also been stated that till the filing of the application, the

Patna High Court Cr.Misc. No.47587 of 2015 (2) dt.03-11-2015 2/2 petitioner has not been put on T I Parade.

The petitioner is in custody since 7.2.2015 and charge-sheet has already been submitted.

In view of the submission as noted above, this application is allowed.

Let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Narari Kala Khurd PS Case No. 5 of 2015.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
