JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This application for grant of regular bail arises out of Chandradeep P.S. Case No.62 of 2015, disclosing offences under Sections 341, 323, 307 and 505/34 of the Indian Penal Code and 25(1-b)A/26/27/35 of the Arms Act. Learned counsel for the petitioner, referring to the First Information Report, submits that it is alleged against the petitioner that he instigated one Md. Ashar to

Patna High Court Cr.Misc. No.46625 of 2015 (2) dt.16-10-2015 2/2 open fire on the informant. He further submits that admittedly no injury was caused to any person and the case has been instituted out of civil dispute between the parties.

In view of the submission as above, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Jamui, in connection with Chandradeep P.S. Case No.62 of 2015.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
