JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 05-05-2016 Husband of the petitioner was a class IV employee under BSNL. He was working under the jurisdiction of Telecom District Manager, BSNL at Hajipur, Vaishali. He died on 18.4.2013 and now the widow has approached the High Court for a direction for settlement of her rightful claim.

The petitioner herself has indicated that the insurance, gratuity, and leave encashment have been paid to the petitioner but the pensionary benefit is not being worked out.

Unfortunately, instead of trying to revert to this Court on the merit of the matter on the pension, all kinds of plea have been taken in the counter affidavit.

Patna High Court CWJC No.10791 of 2014 dt.05-05-2016 2/2 The Court, therefore, disposes of the matter with a direction upon the Telecom Manager, Hajipur that the claim of the petitioner with regard to entitlement of pension etc. will be examined and a final decision will be taken and communicated to the petitioner within a period of three months from the date of production of a copy of this order. If the order is not carried out, the Telecom District Manager will be held liable personally for violation of the directive of the Court.
