JUSTICE ARUN KUMAR ORAL ORDER 25-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Matihani PS Case No. 150 of 2017 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The allegation in brief is that total 2388 bottles of foreign liquor were recovered from the maize field of one co-accused Bhushan Singh.

Learned Counsel for the petitioner submits that only allegation is that this petitioner was also present there, however, the field was of Bhushan Singh and he has been admitted to bail by a coordinate Bench of this Court. The petitioner has no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Dilip Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge 7th -cum- Special Judge, Bihar Prohibiton and Excise Act, Begusarai in connection with Matihani PS Case No. 150 of 2017.
