2. The accused-petitioner is named in the F.I.R and is apprehending her arrest in connection with Khushrupur P.S. Case No. 16 of 2023 registered for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. The allegation against petitioner is to open indiscriminate firing alongwith other named co-accused persons, where during the occurrence son of the informant was shot dead.

4. Learned counsel appearing on behalf of the petitioner submitted that the thrust of allegation is available

No.54295 of 2025(2) dt.08-08-2025 2/3 against named co-accused Dhananjay Singh and this petitioner implicated with present case only being a sister of co-accused, where maximum allegation against petitioner as per narration of FIR is to instigate the co-accused persons without taking their name to open fire as to kill the informant and others. It is submitted that petitioner is a lady of clean antecedent.

5. Learned APP duly assisted by learned counsel Ms. Komal, appearing on behalf of the informant while opposing the prayer of bail submitted that involvement of petitioner as one of the conspirator cannot be ruled out.

Considering the aforesaid facts and circumstances and by taking note of fact as prima facie implication of this petitioner appears being a sister of main co-accused Dhananjay Singh having no allegation qua any overt act as per FIR, except general instigation to other coaccused persons, where petitioner is a lady of clean antecedent, accordingly, above named petitioner, in the event of her arrest or surrender before the learned trial Court, within a period of four weeks of the order, is directed to be

No.54295 of 2025(2) dt.08-08-2025 3/3 released on bail furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Patna City/concerned Court, where the case is pending in connection with Khushrupur P.S. Case No. 16 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C./482(2) of the BNSS.
