2. Petitioner seeks regular bail in a case registered for the offences punishable under Sections 323 , 324, 341 , 342, 307, 384, 387, 504, 506, 147, 149, 327, 447 and 34 of IPC . 3 . As per the prosecution case , on 06.06.2021 at about 5:00 PM , this petitioner along with other co-accused persons started assaulting informant and others and in course of assault, this petitioner Sabrej Dewan assaulted brother of informant with iron rod due to which he sustained injury .
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged. There is pending land dispute between the parties due to which
Patna High Court CR. MISC. No.54492 of 2025(2) dt.19-09-2025 2/2 the alleged incident occurred. Allegation of assault is general and omnibus against this petitioner. Petitioner claims clean antecedent. Petitioner is in custody since 19.04.2025 . Chargesheet has already been submitted. Similarly situated co-accused Sabeya Khatoon has already been granted regular bail by this Hon'ble Court vide order dated 28.06.2024 in Cr. Misc. No. 42797 of 2024 .
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate Ist Class East Champaran Motihari in connection with Turkauliya P.S.
