The petitioner seeks bail in Sadar P. S. Case No. 281 of 2019 instituted for the offence under Section(s) 379, 411/34 of the Indian Penal Code and Section 20/22 of the NDPS Act. Learned counsel for petitioner submits that petitioner has been implicated in this case by the informant due to some altercation had taken place between them while driving the bike. In the written report, it is alleged that while the informant was going on his bike two miscreants snatched his mobile and started running away. It is further alleged that this petitioner, on chase, was apprehended whereas the other miscreant managed to run away. It is further alleged that one

Patna High Court CR. MISC. No.46501 of 2019(2) dt.01-08-2019 2/2 mobile and one match box containing 12 sachet of narcotics substance have been recovered from possession. Seizure list is part of the FIR, wherein, there is no mention of any weight and quantity of the alleged narcotics drugs. From the seizure list, it appears that mobile has been produced by the informant himself before the police. Petitioner is in custody since 28.4.2019 having no criminal antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge- cum- Spl. Judge NDPS, Muzaffarpur, in connection with Sadar P. S. Case No. 281 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
