JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 29-10-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This application for grant of regular bail arises out of Tisiauta P.S. Case No.12 of 2013, disclosing offences under Sections 147, 148, 149, 323, 324, 452, 307, 504/34 and 302 of the Indian Penal Code, Section 27 of the Arms Act and Section 3/4 of the Explosive Substance Act.
Briefly stated, the prosecution case is that the
Patna High Court Cr.Misc. No.47444 of 2015 (2) dt.29-10-2015 2/3 petitioner, alongwith other co-accused persons, had taken away the deceased, namely, Ram Shresth Sahni, and after brutally assaulting him, threw him on the Chour. It is also alleged against the petitioner that he gave blow over the head of the informant with the butt of a pistol.
Learned counsel, appearing on behalf of the petitioner, has referred some orders passed by this Court, dated 14.08.2013, 12.03.2014 and 03.03.2015, passed in Cr. Misc. Nos.27815 of 2013, 4074 of 2014 and 47564 of 2014, respectively, whereby, under similarly situated circumstance, some other co-accused persons have been granted the privilege of regular bail. She further contends that the petitioner is in custody since 07.08.2015.
Considering the submission as above, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Vaishali, in connection with Tisiauta P.S. Case No.12 of 2013.
This is subject to the condition that the petitioner shall present himself before the police/Court,
Patna High Court Cr.Misc. No.47444 of 2015 (2) dt.29-10-2015 3/3 as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
