02-02-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner, in the present case, is seeking regular bail in connection with Banmankhi P.S. Case No. 189/2017 giving rise to Sessions Trial No. 424/2017 registered for the offence punishable under Sections 341, 342, 323, 504, 364, 365, 379/34 of the Indian Penal Code. Learned counsel for the petitioner submits that so far as the present accused is concerned, his name has transpired in the confessional statement of one Binod Sharma. The case of this petitioner is similar to the coaccused Raushan Kumar Bharti and Raja Kumar @ Raja Yadav who have been granted privilege of regular bail by a co-ordinate Bench of this Court. There are general allegations of assault to the informant with fists and slaps

Patna High Court Cr.Misc. No.4839 of 2018 (2) dt.02-02-2018 as also snatching of his mobile. Learned counsel further submits that prior to this case he had no criminal antecedent, however he has been remanded in one case under Excise Act after his arrest in the present case. Learned Additional Public Prosecutor for the State is present and submits that this petitioner is involved in another case as well, however he does not deny the case of this petitioner is similar to that of the co-accused, who has been granted regular bail earlier.

Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) with two sureties of the like amount each to the satisfaction of the learned Presiding Officer Fast Track Court - I, Purnea, in connection with Banmankhi P.S. Case No. 189/2017 giving rise to Sessions Trial No. 424/2017, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
