The petitioner seeks anticipatory bail in a case instituted for the offences under Sections of 420, 467, 468, 471 and 504 of the Indian Penal Code.
It has been alleged that Sarfaraj Alam by committing fraud has obtained signature on the document which was later on transpired that it was execution of the sale deed by the petitioner in his favour. Allegation has been made that he was called to purchase the land but wrongly he has obtained the signature.
Learned counsel for the petitioner submits that petitioner is not beneficiary rather he is only an identifier.
Patna High Court Cr.Misc. No.23891 of 2017 (2) dt.01-07-2017 Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioners, namely, Irsad Alam, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate (West), Muzaffarpur in connection with Kanti P.S. Case No.62 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
