This is an application for grant of regular bail on behalf of the petitioner who is an accused in connection with Khaira PS Case No. 132 of 2015 for the alleged offences punishable under Sections 302 and 201/34 of the Indian Penal Code, pending in the court of Sri U K Pandey, Judicial Magistrate 1st Class, Jamui.
The petitioner is the husband of the deceased who was married to the petitioner nearly 17 years before the institution of the first information report. Referring to the FIR, learned counsel for the petitioner has submitted that no offence under Section 302 IPC is made out against the petitioner as there is no allegation of any overt-act against him and his implication is based
Patna High Court Cr.Misc. No.46072 of 2015 (2) dt.13-10-2015 2/2 merely on suspicion and hearsay.
I find substance in the submission made on behalf of the petitioner. Accordingly, this application is allowed. Let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri U K Pandey, Judicial Magistrate 1st Class, Jamui, in Khaira PS Case No.132 of 2015.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
