JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 06-10-2017 Even though various orders are made in the writ petition filed in public interest while taking cognizance of the issue in question on 26.04.2017, this Court was concerned with regard to certain queries made by the Chancellor of the University vide Annexure-2 on 12.04.2016 from the Registrar, Magadh University, Bodh Gaya and it was the case of the petitioner that in spite of the queries made by the office of the Chancellor, the University has not

Now, from the counter affidavit filed by the respondents, we find that in response to the query made by the Chancellor, the University has, vide confidential memo Annexure13 dated 30th May, 2016, communicated to the officer on Special Duty (University) and Secretariat of the Chancellor (Governor) and now the matter is pending before the Chancellor (Governor). That being so, Officer on Special Duty to whom the communication, Annexure-13, has been addressed, shall place the matter before the Chancellor, who may take a decision in the matter, if not already taken. We may indicate that we have not expressed any opinion on the merits of the case and it is exclusively for the Chancellor to deal with the issue in case it has not been addressed till date.
