01-02-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner, in the present case, is seeking regular bail in connection with Nawada Nagar (Bundelkhand) P.S. Case No. 736/2017 registered for the offence punishable under Sections 395, 397 of the Indian Penal Code and 27 of the Arms Act.

Learned counsel for the petitioner submits that this petitioner and the informant are residing in the same Mohalla. The petitioner is running his mobile shop. From the F.I.R. it appears that according to the informant 18 - 20 unknown persons lashed with arms entered in her house and committed dacoity. Learned counsel submits that this petitioner has been implicated later on only on

Patna High Court Cr.Misc. No.4404 of 2018 (2) dt.01-02-2018 suspicion as there is no identity disclosed in the F.I.R. The petitioner is in custody since 10.11.2017, and till date there is no test identification of this petitioner. There are two cases against him in which he is on bail.

Learned counsel for the State opposes the prayer for bail.

Considering the facts and circumstances of the case particularly that the F.I.R. is against unknown 18 - 20 persons and the petitioner is said to be residing in the same Mohalla and having a shop and was not identified, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada, in connection with Nawada Nagar (Bundelkhand) P.S.
