JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-02-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 399/402 of the Indian Penal Code and sections 25(1-B)a, 26 and 35 of the Arms Act and sections 4/5 of the Explosive Substance Act. As per the prosecution case, one loaded country made pistol, six live cartridges and five bomb were recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 10.6.2021. Investigation is complete.

Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in Muffafsil Police Station Case No. 263 of 2021.
