====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 20-11-2024 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in connection with Amba P.S. Case No.80 of 2024, G.R. No.1014 of 2024 instituted under Sections 201, 304(B)/34 of the Indian Penal Code.

3. As per the prosecution case, the marriage of the informant's daughter was solemnized with one Sabir Kumar in the year 2019. It is alleged that the petitioners who are the relative of deceased have tortured her for non-fulfillment of dowry demand of motorcycle. It is further alleged that the petitioners killed the deceased and the informant was informed through video call by the brother-in-law of the deceased namely Satveer Ram (petitioner no.7) that the daughter of informant (deceased) had died. It is further alleged that the dead body of deceased was disposed of by the accused persons.

4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. She further submits that petitioners who are sister-in-law (Nanad), brother-in-law (Nandoshi), sister-in-law (Gotani), mother-in-law, brother-in-law (Dewar), father-in-law and brother-in-law (Bhaisur) of the deceased respectively have been made accused only on the basis of suspicion. Learned counsel submits that the husband of deceased is handicapped and the deceased was not happy with her conjugal life. She further submits that the deceased was taken to hospital but in the way she died. Learned counsel submits that there is no material against the petitioners and they have no criminal antecedent.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount to each to the satisfaction of the learned C.J.M., First Class, Aurangabad in connection with Amba P.S. Case No.80 of 2024, G.R. No.1014 of 2024, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
