JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 07-10-2015 The petitioner seeks bail in connection with Dumariya P.S. Case No. 06/12 registered under Sections 144, 147, 149 of the Indian Penal Code and 25(1-B)(a), 26 and 35 of the Arms Act and Sections 3, 4, 5 of the Explosive Substances Act and Section 17 of the Criminal Law Amendment Act. The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 03.03.2015 passed in Cr. Misc. No. 51757 of 2014 with observation that the petitioner would be at liberty to renew his prayer for bail after framing of charge.

It is contended that though the petitioner is in

Patna High Court Cr.Misc. No.46904 of 2015 (2) dt.07-10-2015 2 / 2 custody since 17.06.2014, till date only charges have been framed and no witness has been examined on behalf of the prosecution during trial.

Regard being had to the facts and circumstances of the case, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-II, Gaya in Sessions Trial No. 10 of 2015/200/2015 arising out of Dumariya P.S. Case No. 06/2012.
