2. The petitioners apprehend arrest in connection with Ara Muffasil P.S. Case No. 100 of 2026 lodged on 01.04.2026, for the offence punishable under Sections 126(2), 115(2), 352, 351(2), 109 & 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution, FIR has been lodged against 4 named accused persons (all the present petitioners). The specific allegation is against petitioner nos. 3 and 4 who have assaulted the informant on his head by means of rod and danda,

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. He submits that for the same date and place of occurrence dated 31.03.2026, the FIR has been lodged from the informant's side and complaint has been lodged from the petitioner's side when the police has refused to lodge FIR even after sending information to S.P., Bhojpur. Counsel submits that both parties are adjacent neighbours and due to construction of Chhajja on the land of the petitioners, dispute has arisen between them. He further submits that the petitioners have clean antecedent and the injury is simple in nature and case has been lodged from both the sides.

5. Learned APP for the State opposes the prayer for bail of the petitioners but fairly submits that for the same date and place of occurrence dated 31.03.2026, there are case and counter case filed from both the sides.

6. As such, in the present facts and circumstances of this case, let the above named petitioners be released on bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of

Case No. 100 of 2026, subject to the conditions as laid down U/s 482(2) of the B.N.S.S., 2023.
