JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-11-2015 This is an application for grant of regular bail in favour of the petitioner who is an accused in connection with Sessions Trial No. 44 of 2015/294 of 2015 arising out of Bodhgaya PS Case No. 252 of 2014 for the alleged offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the FIR was instituted against unknown. The dead body of the deceased was found floating in a water body. In course of investigation, it was transpired that the wife of the deceased had illicit relationship with one Jawed Mian and she had conspired with Jawed Mian to get the deceased eliminated. Learned counsel for the petitioner has produced before me web copies of the order passed by this Court, whereby

Patna High Court Cr.Misc. No.47712 of 2015 (2) dt.04-11-2015 2/2 some of the co-accused persons have been granted bail. He has specifically referred to the order dated 23.9.2015 passed in Cr. Misc. No. 36561 of 2015, whereby the said Md. Jawed has been granted regular bail.

Considering the submission as above, this application is allowed.

Let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge IX, Gaya, in Sessions Trial No. 44 of 2015/294 of 2015 arising out of Bodhgaya PS Case No.252 of 2014.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
