The petitioner is in custody since 12.08.2015 in connection with a case registered the offences punishable under Sections 406/379 of the Indian Penal Code.

Learned counsel for the petitioner submits that save and except the confessional statement made before the Police by the petitioner on having been apprehended on the basis of certain call details made between the petitioner and one Prakash Kumar, the petitioner was taken into custody and there is no further material anywhere to connect this petitioner with the present occurrence. He further submits that though the petitioner has been in custody since 12.08.2015 and has no criminal antecedent and he has not been put on Test Identification Parade in the interregnum also, he

Considering the aforementioned fact and circumstances of the case, let the petitioner Gaurab Kumar be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali in connection with Bhagwanpur P.S. Case No. 132 of 2015.
