Petitioner, already in custody, seeks bail in connection with Bihariganj P.S. Case No.328 of 2017, registered under Sections 30 (a), 37 (b), (c) of the Bihar Prohibition and Excise Act, 2016. Allegation in brief is that 25 liquor of Mahua liquor was recovered from the house of the petitioner and the petitioner was found in drunken condition.

Submission is that small quantity of recovery is alleged to be made, the petitioner is in custody since 16.11.2017 and he has no criminal antecedent.

Having considered the said facts and circumstances, petitioner Mohan Kumar @ Mohan Choudhary is directed to be

Patna High Court Cr.Misc. No.4246 of 2018(2) dt.29-01-2018 2/2 released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge IIIrd-cum-Special Judge Excise Act, Udakishunganj at Madhepura.
