Petitioner is in custody in connection with Special (Excise) Case No. 174 of 2019 arising out of Basnahi P.S. Case No. 35 of 2019 for the offence under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner would submit that petitioner has no criminal antecedent.

It is alleged that total 20 liters of illegal country made foreign liquor was seized from the possession of the petitioner. Learned counsel for the petitioner submits that petitioner is in custody since 08.04.2019.

Considering the fact that petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner,

Patna High Court CR. MISC. No.45971 of 2019(2) dt.25-07-2019 2/2 let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Saharsa, in connection with Special (Excise) Case No. 174 of 2019 arising out of Basnahi P.S. Case No. 35 of 2019.
