Learned counsel for the petitioner submits that earlier the petitioner has filed a representation before the Director, Primary Education, Government of Bihar, Patna (respondent no.2), a

Patna High Court CWJC No.12850 of 2022(4) dt.04-04-2024 2/2 copy of which is enclosed at Annexure-4 series but till date, the representation has not been disposed of. It is submitted that the case of the petitioner is squarely covered by the judgment of the Apex Court passed in Writ Petition (Civil) No.1052/2021 (Sunil Kumar Rai & Ors. Vs. The State of Bihar & Ors.) reported in 2022(2) BLJ(SC) 208.

Accordingly, the petitioner is directed to file a fresh representation enclosing a copy of the order passed by the Apex Court, before the respondent no.2 within a period of two weeks from today and the respondent no.2 is well advised to dispose of the representation of the petitioner, after personally hearing the petitioner or his counsel, and pass a reasoned and speaking order in accordance with law, within a period of ten weeks from the date of filing of such representation by the petitioner. 4.

With the aforesaid directions, this writ application is hereby disposed of.
