Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 Arms Act.
The informant saw that co-accused-Sanjay Yadav fired at his brother-Rabindra Pandey which resulted in death of Rabindra Pandey. Petitioner is not named in the FIR. Submission is that co-accused-Pramod Yadav has already been allowed bail by this Court in Cr. Misc. No.19722 of 2019.
Learned counsel for the informant opposed the prayer for bail on the ground that the petitioner is a man of the gang of Sanjay Yadav and he is accused in several criminal

Considering the fact that there is no direct evidence against the petitioner subsisting involvement of the petitioner in this crime, hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Obra Police Station Case No.217 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
