====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 06-04-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody since 17.1.2018, seek bail in Amarpur PS Case No. 15 of 2018 registered under Sections 148, 149, 323, 341, 307 of the IPC and Section 27 of the Arms Act. The allegation in brief is that all the three petitioners assaulted the informant with khanti, when others came to rescue they too were assaulted by them.

Submission is that there is case and counter case between both sides as both live in the neighbourhood, three persons are said to have assaulted but there is no specific allegation, however, the injuries found on the person of the informant and others are simple in nature except one injury to Shiv Kumar Sharma but that is not on vital part of the body.

Having considered the said facts and circumstances, the petitioners, namely, Dayanand Sharma, Achyutanand Sharma and Uday Kumar Sharma alias Udai Sharma are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) by each one of them with two sureties of the like amount each to the satisfaction of CJM Banka in connection with Amarpur PS Case No. 15 of 2018.
