JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 12-07-2022 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioners as well as the learned APP for the State.

The petitioners apprehend their arrest in connection with Chanpatia P.S. Case No. 276 of 2021, registered for the offences punishable under Sections 147, 148, 149, 447, 341, 323, 324, 354 (B), 385, 379, 504, 506 of the Indian Penal Code. As per allegation, there was previous land dispute between the prosecution side and the defense side. In the morning of occurrence, six named accused persons came to the house of the informant and started assaulting her. Co-accused Santosh Thakur thrust her on the ground. Co-accused Beauty

Patna High Court CR. MISC. No.59824 of 2021(2) dt.12-07-2022 2/2 Kumari snatched gold earrings from her ears. Co-accused Ashesar Thakur assaulted the informant with dab on her head. The accused persons also assaulted Neeraj Kumar and Dhiraj Kumar, sons of the informant.

Learned counsel for the petitioner has submitted that they are persons of clean antecedents. There is admittedly land dispute between both the parties. The defense side has lodged a case against the informant side and the members of defense side had also sustained injuries.

Considering the above-mentioned facts and circumstances as well as clean antecedents of the petitioners, let them, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah in connection with Chanpatia P.S. Case No. 276 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
