Petitioner, already in custody, seeks bail in connection with Madanpur P.S. Case No.87 of 2014, giving rise to Sessions Trial No.18 of 2018/5 of 2018, registered under Sections 3⁄4 of the Explosive Substance Act as well as under Section 17 of the CLA Act.
Allegation in brief is that police team during the search operation recovered explosives, detonator and other incriminating articles from the forest area and it is alleged that the accused persons operate a naxal group and involved in the present occurrence.
Learned counsel for the petitioner submits that merely on the basis of suspicion the petitioner has been made accused
Patna High Court Cr.Misc. No.22740 of 2018(2) dt.17-04-2018 2/2 in this case, however there is no recovery of any explosive from possession of the petitioner and similarly situated another coaccused Sunil Khatri has been admitted to bail by a coordinate Bench of this Court vide Cr. Misc. No.2251 of 2017 on 04.02.2017.
Having considered the aforesaid facts and circumstances, petitioner Sanoj Sao is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ad hoc ADJ, Fast Track Court-VII, Aurangabad in connection with Madanpur P.S. Case No.87 of 2014, giving rise to Sessions Trial No.18 of 2018/5 of 2018.
