Petitioners seek bail in Suryagarha P.S.Case No. 227 of 2020 registered for the offences punishable under Sections 401 of the Indian Penal Code and 25 (1-B)a, 26,35 of the Arms Act.

As per prosecution case, two accused persons namely, Amarjeet Kumar and Bhupendar Kumar were apprehended and on their discloser arms and ammunition were recovered. Both the accused persons stated that the alleged arms and ammunition were used in crime by them and their associates. They disclosed

Petitioners have been made accused on the basis of confessional statement of co-accused, who were apprehended. No incriminating article has been recovered from possession the petitioners. Petitioners are in custody since 05.01.2021. Similarly situated co-accused persons have been granted bail by co-ordinate Benches of this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate Lakhisarai in connection with Suryagarha P.S.
