The petitioner is accused in connection with S.C. No. 224 of 2015 arising out of Mahesh Khunt P.S. Case No. 05 of 2014 registered under section 304(B) of the I.P.C. pending in the Court of A.D.J. 3rd, Khagaria.

The prosecution case is that the marriage of the daughter of the informant was performed with this petitioner in September, 2010 after providing the house hold articles and ornaments. In spite of that, demand of motorcycle in dowry was being made by this petitioner. Further, case is that Sunity Devi, daughter of the informant, was taken by this petitioner 20 days ago and on 28.12.2013, the informant received information about

Patna High Court Cr.Misc. No.46747 of 2015 (5) dt.16-03-2016 2/2 committing murder of his daughter and disposing of her dead body on 31.12.2013. When the informant reached at the matrimonial home of her daughter, then he came to know that his daughter was taken by the petitioner but on search, no trace was found. Learned counsel appearing on behalf of the petitioner submits that in fact, petitioner happens to be husband of Sunita Devi, daughter of the informant. Further submission is that in fact, petitioner was kidnapped by his wife Lalita Devi and her lover Krishna Mehta, regarding which co-accused Nirmala Devi, mother of the petitioner, lodged the Complaint Case No. 32C of 2014 in the Court of C.J.M., Khagaria, which was sent for investigation under section 156 of the I.P.C. to the concerned Police Station. Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the petitioner on bail. Accordingly, prayer of the petitioner for bail is rejected.
