JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 28-02-2018 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

The petitioner wants to renew his prayer for bail which was earlier rejected vide orders dated 11.07.2016 and 06.09.2017 passed in Cr. Misc. Nos. 22117 of 2016 and 42390 of 2017, on the ground that the petitioner is suffering in custody since 03.10.2015, up till now no prosecution witness has been examined and in the near future the trial is not likely to be concluded, there was direction to conclude the trial within four months, there is no progress in the trial.

The learned A.P.P. opposes prayer for bail of the petitioner.

In the facts and circumstances stated above, at

Patna High Court Cr.Misc. No.10518 of 2018 (2) dt.28-02-2018 2/2 present finding no good ground for reconsideration of prayer for bail, again prayer for bail of the petitioner stands rejected in connection with Sessions Trial No. 29 of 2016 arising out of Jokihat P.S. Case No. 122 of 2003 pending in the court of 2nd Additional Sessions Judge, Araria.

However, considering the period of detention, the trial court is directed to expedite the trial and to conclude the same as early as possible preferably within a period of two months from the date of receipt/production of a copy of this order, failing which the petitioner, if at no fault, may be at liberty to renew his prayer for bail.
