Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of Arms Act.
Two unknown person allegedly committed murder of Akhilesh Kumar Singh by causing firearm injury. During investigation, co-accused-Shambhu Paswan confessed before the police that the petitioner had told that some dispute for taking contract was there with the deceased, hence, Shambhu Paswan should watch on the movement of the deceased. Shambhu Paswan has already been allowed bail by a Coordinate Bench of this Court vide Annexure-2. Submission is that besides suspicion there is no
Patna High Court CR. MISC. No.46043 of 2019(2) dt.26-07-2019 2/2 direct material against the petitioner. Petitioner is in custody since 14.05.2019.
Learned counsel for the informant opposed the prayer for bail on the ground that the petitioner has got criminal antecedent and the material in the case dairy would reveal that the petitioner was main conspirator in the perpetration of the crime.
Considering the facts aforesaid, let the petitioner, above named, be released on bail after completion of investigation on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Itarhi Police Station Case No.45 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
