JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 29-06-2021 Heard learned counsel for the petitioner and Mr. Akhileshwar Dayal, learned APP for the State. The petitioner in the present case is seeking regular bail in connection with Ara Nagar P.S. Case No. 275 of 2013 and Sessions Trial No. 75 of 2020 registered for the offences punishable under Section 302, 307, 34 of the Indian Penal Code. Learned counsel for the petitioner submits that as per the prosecution story on 20.7.2013 informant's younger brother was sitting on his shop. In the meantime, accused persons Anil Yadav and Santosh Yadav @ Rajesh came to his shop and started drinking liquor there, when the informant brother objected them, this petitioner Anil Yadav fired on him. Learned counsel submits that the petitioner is innocent and has falsely been implicated in the present case.

Having regard to the facts and circumstances of the case wherein there is a direct allegation of firing against this petitioner on the abdomen of the brother of the informant and the post-mortem report shows the injuries in the said region, this court is not inclined to release of the petitioner on bail. The prayer for regular bail of the petitioner is, thus, refused. Let the trial be expedited.
