The petitioner apprehends his arrest in Katoria P.S. Case No. 20 of 2018, registered for the offences punishable under Sections 341, 323, 354, 504, 506 and 34 of the Indian Penal Code.
Prosecution case in brief is that on the alleged date and time of occurrence while the informant was sleeping in verandah with her child in the meantime, Pintu Tanti (petitioner) son of her elder brother-in-law (Bhaisur) entered her house and caught hold of her and when informant raised alarm petitioner fled away.
It is submitted that petitioner has been falsely implicated in this case. Both parties are close agnates. There is
Patna High Court CR. MISC. No.59448 of 2021(2) dt.04-07-2022 2/2 case and counter case. Earlier a case bearing Katoriya PS Case No. 264 of 2014 was registered against informant and her husband and in order to take revenge the informant at the instance of her husband filed this false and frivolous case. Petitioner has got clean antecedent.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Banka in connection with Katoria P.S. Case No. 20 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
