The petitioner seeks bail in connection with Pakridayal P. S. Case No. 150 of 2013 registered under Sections 25(1-B)a and 26 of the Arms Act and Section 17 of the Criminal Law Amendment Act.
The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 25.11.2014 passed in Cr. Misc. No. 41931 of 2014 with following observations:- "Having regard to the criminal antecedent of the petitioner, I am not inclined to grant him bail for the present. Accordingly, the prayer
Patna High Court Cr.Misc. No.46312 of 2015 (3) dt.17-02-2016 2/2 for bail is rejected. Since the petitioner is in custody for over one year, the court below is directed to hold the trial on day-to-day basis and conclude the same as early as possible preferably within six months from the date of receipt/production of a copy of this order failing which the petitioner would be at liberty to renew his prayer for bail."
Regard being had to the fact that the prosecution has not yet produced all its witnesses during trial, the petitioner above named, who is in custody since 06.11.2013, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sikrahana at Motihari in Pakridayal P. S. Case No. 150 of 2013.
