JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 07-01-2015 A supplementary affidavit has been filed today on behalf of the petitioner, which is kept on record. Heard learned counsel for the petitioner and learned counsel representing the State.
The petitioner apprehending her arrest in connection with Ahiyapur P.S. Case No. 643 of 2012 registered for the offences under Sections 147, 148, 323, 307, 354, 379, 452, 504 and 34 of the Indian Penal Code seeks privilege of pre arrest bail.
It is submitted that in this case the husband of the petitioner has already been allowed pre arrest bail vide Cr. Misc. No. 53280 of 2013 by order dated 15.05.2014 and as such the petitioner also deserves sympathetic consideration to which the learned APP does not dispute.
Considering the aforesaid facts, in case of arrest or
Patna High Court Cr.Misc. No.28736 of 2014 (3) dt.07-01-2015 surrender before the court below within one month from the date of receipt/production of a copy of this order, the petitioner namely Lalo Devi shall be released on bail on execution of bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 643 of 2012 with condition as laid down under Section 438(2) Cr.P.C.
