Petitioners are apprehending their arrest in connection with G.R. No. 250 of 2024 arising out of Nabinagar P.S. Case No.129 of 2024, registered for the offence punishable u/s 30(a) and 30(c) of the Bihar Prohibition and Excise Act, 2018.

Recovery is of 2000 litres of illicit soaked mahua, 115 litres of desi illicit liquor and utensils used for manufacturing illicit liquor.

It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have not
Patna High Court CR. MISC. No.52466 of 2024(2) dt.31-08-2024 2/2 committed any offence. They have been falsely implicated in this case due to ulterior motive. Nothing have been recovered from the conscious possession of the petitioners. Petitioners were not present at the time of occurrence. The petitioners are one criminal antecedent of same nature.

Learned APP for the State opposed the prayer for bail by submitting that the petitioners are the members of the syndicate involved in manufacturing illicit liquor. 6.
Considering the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail is hereby rejected. 7.
This application is accordingly dismissed.
