ANJANA MISHRA ORAL ORDER 01-02-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State.

The petitioner is in custody since 23.07.2017 in connection Khaira P.S. Case No.214 of 2017 registered for the offence under Sections 25(1-b)a and 26 of the Arms Act. Learned counsel for the petitioner submits that though the petitioner was arrested outside his residence in the native village, the seizure list has been prepared and there is no independent witness to it. He further submits that there was no recovery from his conscious possession.

Considering the aforementioned facts and circumstances and that the petitioner has been in custody for almost four months, let the petitioner, above named, be released

Patna High Court Cr.Misc. No.5565 of 2018 (2) dt.01-02-2018 2/2 on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Manish Kumar Pandey, learned Judicial Magistrate, 1st Class, Jamui, in connection with Khaira P.S. Case No.214 of 2017.
