The petitioner, who is the wife of a deceased employee of United Bank of India, seeks appointment on compassionate ground.

Though the death took place in the year 1997, but immediately thereafter, the petitioner made an application for being considered for being appointed in accordance with the scheme prevalent in the Bank for compassionate appointment. Certain documents were also demanded by her as late as in the year 2003, to which the petitioner replied and furnished the documents demanded, but no decision was

Several representations of the petitioner went unheeded. Sometimes in the year 2006, the petitioner was asked to furnish details of liabilities and the said information also was provided by the petitioner but no decision has yet been taken.

The petitioner, under the aforesaid circumstances, is constrained to come to this Court for a direction to the respondent authorities to consider her case and pass an order at the earliest.

Though the purpose of compassionate appointment is to provide immediate succour to the family of the deceased employee and it is an immediate step and not a mode of appointment; nonetheless the employer of the late husband of the petitioner had asked for certain details from the petitioner who had applied for being considered for such compassionate appointment. In that event, it was necessary for the respondent / Bank to have taken a decision and communicated the same to the petitioner. That not having been done has led to discontent and the filing of the present

Under the aforesaid circumstances, this Court directs the petitioner to make a fresh representation before the Chief Regional Manger, United Bank of India, Regional Office, Patna, ventilating her grievance within a period of four weeks, who, on receipt of the same, shall verify the facts and the scheme for compassionate appointment and shall pass order in accordance with law in tune with the scheme of compassionate appointment, if available, within a further period of six weeks thereafter.

With the aforesaid observation / direction, this petition stands disposed off.
