Petitioner renews his prayer for bail in connection with Pratapganj PS Case No. 114/2020 registered for the offence punishable under Sections 392 of the IPC inasmuch as earlier bail application of the petitioner was rejected vide order dated 24.06.2021 passed in Cr. Misc No. 4802/2021 (Annexure-1) with liberty to renew his prayer for bail after three months. The allegation, as per prosecution case in brief, is that the informant was accosted by four unknown miscreants who snatched the bag containing Rs. 49 Lacs, a mobile phone as well as Rs. 5000/- from the informant and also threatened him of dire consequences.

Learned counsel for the petitioner submits that petitioner has got no criminal antecedents and he has falsely been implicated in this case merely because he was found sitting

Patna High Court CR. MISC. No.60561 of 2021(2) dt.27-10-2021 2/2 in the vehicle from-where the looted amount of Rs. 49 Lacs was recovered by the police. Learned counsel next submits that the petitioner is not the owner of the said vehicle from where recovery was made. He further submits that the petitioner is in custody since 26.08.2020 and the trial is not likely to be concluded in near future due to pandemic of COVID-19. Regard being had to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioner is in custody since 26.08.2020 having no criminal antecedents and this is the second attempt for bail on behalf of petitioner, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, AMIT KUMAR SHARMA @ AMIT KUMAR @ AMIT SHARMA be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Birpur (Supaul) in connection with Pratapganj PS Case No. 114/2020.
