JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-03-2018 Earlier prayer for bail of the petitioner was dismissed vide order dated 05.07.2017 passed in Cr. Misc. No. 23889 of 2017 with direction to the trial court to expedite and conclude the trial within a period of six months and liberty was given to the petitioner that if the trial is not concluded, he may renew his prayer for bail.

Submission of learned counsel for the petitioner is that the main accused against whom there was allegation of firing on the deceased, has already been released by a Bench of this Court vide order dated 05.12.2011 passed in Cr. Misc. No. 18818 of 2011 and petitioner has been in judicial custody since 20.03.2017 and uptil now charge has not been framed as other accused has not appeared.

Considering the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing

Patna High Court Cr.Misc. No.5863 of 2018 (4) dt.28-03-2018 2/2 bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -X, Saran, Chapra, in connection with Marhowrah P.S. Case No. 148 of 2004, with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part two appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
