The petitioner seeks bail in Hajipur Sadar P.S. Case No. 400/2018, instituted for offence under Section(s) 420, 120B of the Indian Penal Code read with Sections 30(a) and 38(1) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner has submitted that petitioner was not present on the spot. There is no recovery of any incriminating article from conscious possession of this petitioner.

It is alleged in the written report that on getting secret information police party reached at Loha Singh Line Hotel and saw one truck and one Brezza Car standing in suspicious condition. It is alleged that three persons were apprehended

Patna High Court CR. MISC. No.46663 of 2019(2) dt.01-08-2019 2/3 from Brezz Car. The police recovered 4781.88 litres of foreign liquor from the truck. In the meantime, police apprehended two persons, who came on motorcycle. They disclosed their name as Pramod Kumar and Sonu Kumar Gupta. They further disclosed that they were going to deliver aforesaid liquor, loaded on truck, to Sonu Gope (Petitioner) and Ganesh Rai.

In this manner, name of this petitioner has come in the statement of co-accused.

Petitioner is in custody since 23.02.2019 having clean antecedent.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge-cum-Special Judge, Excise, Hajipur, Vaishali, in connection with Hajipur Sadar P.S. Case No. 400/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
