The application with respect to petitioner no. 1, who is the father in law of the deceased has earlier been withdrawn because of his having been arrested. The petitioner no. 2 seeks bail in anticipation of her arrest in connection with Jamui P.S. Case No. 221 of 2020 instituted for the offences under Sections 302, 304(B) and 498A/34 of the Indian Penal Code.

The deceased was married to one Deepak Ram, who did not treat the deceased well. On one occasion, in front of the brother of deceased, she was assaulted on the

Patna High Court CR. MISC. No.4980 of 2021(3) dt.25-10-2021 2/2 charge of the mobile phone having been stolen. The learned counsel for the petitioner has submitted that from the surrounding / attendant facts, it appears that because of the assault perpetrated on her in presence of her brother, she committed suicide and also administered poisonous substance to her infant son. He has further submitted that there nothing on record or in the investigation papers to indicate that the relationship of the petitioner was so strained that the infant son also would have been killed.

The husband of the deceased is in custody. The husband of the petitioner also has been taken into custody. Considering the afore-noted facts and the gender of the petitioner, the provisional bail granted to her by order dated 06.08.2021, is hereby confirmed. She shall remain on the same bail bonds.
