Mr. Ajit Kumar Singh Mr. S.M.Ashraf =========================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA PRAKASH ORAL JUDGMENT Date: 17-07-2015 The petitioners seek quashing of the order dated 18.03.2009 passed by the Additional Sessions Judge F.T.C. II Munger.

The case of the complainant is that she was married to Sanjay Sah but she was tortured for ends of dowry on account of which she filed Divorce Case No. 17 of 2004 and Kotwali P.S. Case No. 202 of 2004. Subsequently she learnt that her husband had married the Petitioner no. 1 after having taking huge amount of dowry. The petitioner no. 2 happens to be the father of Petitioner no. 1 The submission of the petitioners is that the allegations are baseless and there is no evidence to corroborate the charge and in any event no offence would be made out as against the petitioners

Patna High Court Cr.Misc. No.18234 of 2009 dt.17-07-2015 2/2 even conceding the allegations .

Considering such submission the application is allowed and the order 18.03.2009 passed by the Additional Sessions Judge F.T.C. II Munger is hereby set aside.
