The petitioner apprehends his arrest in connection with Chaika P.S. Case No.129 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The accusation is that on receiving information about doing the business of illicit liquor by some persons besides the betel shop situated in front of Hajipur Market at Chakia Railway Station Road, the informant along with other police personnel reached there. On seeing the police party, three persons started to flee away. On chase, while two persons succeeded to flee away but one was apprehended, who disclosed his name as Raja Kumar and on search, he was found in possession of 750 ml.

Patna High Court CR. MISC. No.46237 of 2019(2) dt.26-07-2019 2/2 Indian Made Foreign Liquor. The apprehended accused also disclosed the name of the petitioner and one Deepak Kumar alias Jhagru, who succeeded to flee away.

Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot and he has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 9th Additional Sessions Judgecum-Special Judge, Excise, Motihari, East Champaran, in connection with Chakia P.S. Case No.129 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
