JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-01-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Baikunthpur P.S. Case No. 164 of 2020 for the offence under Sections 272 and 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act 2016 and Amended Excise, 2018.

Earlier prayer for bail was rejected by this Court vide order dated 23.09.2020 passed in Cr. Misc. No. 24770 of 2020. Learned counsel appearing on behalf of the petitioner submits that the petitioner has no criminal antecedent and he has remained in custody for more than six months.

The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge-2nd cum Special Judge, Excise, Gopalganj in connection with Baikunthpur P.S. Case No.164 of 2020.
