JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 11-09-2017 The petitioners are alleged to have tortured the opposite party no. 2/complainant for non-fulfilment of demand of Rs.50,000/- in various ways. There is allegation that on 25.06.2013, the petitioners had assaulted the complainant and the petitioner Dharmshila Devi ordered to sprinkle kerosene oil and set her on fire. 2.
The allegations made in the complaint have been supported by the complainant in her solemn affirmation. Besides the complainant, three witnesses, namely, Munna Pandit, Yadunandan Pandit and Mukesh Kumar have also supported the allegations made
Patna High Court Cr.Misc. No.28428 of 2014 dt.11-09-2017 2/2 in the complaint in course of inquiry conducted under Section 202 of the Code of Criminal Procedure pursuant to which the learned SubDivisional Judicial Magistrate, Masaurhi, Patna had summoned the petitioners to face trial.

Having gone through the materials available on record, I see no illegality in the order dated 27.09.2013 whereby the petitioners have been summoned to face trial. 4.
In that view of the matter, I see no merit in this application filed under Section 482 of the Code of Criminal Procedure challenging the aforestated order dated 27.09.2013 passed by the learned Sub-Divisional Judicial Magistrate, Masaurhi, Patna in Complaint Case No. 201(C) of 2013.
