JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. One Bajaj Platina motorcycle was recovered from the place of occurrence and on the basis of the aforesaid recovery, the petitioner was arrested form his house.
The contention on behalf of the petitioner is that on the alleged date of occurrence, two unknown persons had snatched the motorcycle of his brother regarding which petitioner gave a written complaint to officer-in-charge of the Taprapur but the officer-in- charge did not register the case. Moreover, petitioner does not have any criminal antecedent.
Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two
Patna High Court Cr.Misc. No.46720 of 2015 (2) dt.05-10-2015 2/2 sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Banka in connection with Belhar P.S.Case No. 144 of 2015.
