Learned counsel for the petitioner is directed to remove the defect(s) as pointed out by the office within a period of four weeks.

The petitioner seeks bail in a case registered under Section-379 of the Indian Penal Code.

Prosecution case in short is that five buffaloes were found missing from house of the informant.

It has been submitted that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 01-06-2022. Charge sheet has already been submitted in this case. The petitioner is not named in the FIR. The petitioner has been made accused due to mistake

Patna High Court CR. MISC. No.49186 of 2022(2) dt.21-12-2022 2/2 of fact. The offence is triable by Magistrate. On behalf of the State, it is submitted that the petitioner is not named in the FIR.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Barh, Patna in connection with Pandarak P.S.
